Khorezm regional territorial administration of the Antimonopoly Committee:
- controls market concentration by prior approval in accordance with the procedure established by law for the acquisition of shares (interests) in the authorized Fund (authorized capital) of an economic entity, as well as for the merger or incorporation of economic entities by a group of individuals;
– products, assessment of market concentration in financial and digital markets;
– provides consulting services on issues related to obtaining shares (interests) in the authorized capital of an economic entity (authorized capital) by a group of individuals and legal entities, as well as on issues related to obtaining prior consent to transactions related to the merger or incorporation of economic entities.
Obtaining preliminary consent from the Antimonopoly Agency to receive a share (shares) in the Charter Fund (Charter capital) of a business entity is carried out through the Centers of providing the state services in accordance with the Administrative regulations, approved by the Annex 1 to the decree of the Cabinet of Ministers of 28 may 2020 No. 338, and requires the consent in the following cases:
if such person or group of persons acquires the right to dispose of more than fifty percent of these (shares);
if the total book value of assets of persons involved in the transaction, or the total revenue from the sale of tokens during the last calendar year exceeds hundred thousand times the amount of the basic calculation, or if one of the parties to the transaction is an economic entity occupying a dominant position in the market.
Obtaining preliminary consent for joining and joining of economic entities is carried out through the centers for providing public services in accordance with the Administrative regulations approved by Annex 2 to the 338th resolution of the Cabinet of Ministers of may 28, 2020.
If the total book value of the assets of the persons participating in the relevant transaction, or the total revenue from the sale of tokens for the last calendar year exceeds one hundred thousandth of the base calculation amount, or if one of them is an economic entity that occupies a dominant position in the commodity or financial market, then it is considered bankrupt.
