The Consumer Protection Agency of the Antitrust Committee of the Republic of Uzbekistan, through the "Call Center", received an appeal from a citizen living in the Amudaryin district of the Republic of Karakalpakstan on this issue.
In this appeal, the citizen appealed to the territorial administration with a request to provide practical assistance.
As it turned out, he bought a TV with good intentions in a shop in urgench for 3,700,000 soums. However, the TV broke down before the warranty period expired. No action was taken on the appeals of the store's employees on this issue.
Employees of the territorial administration of the seller were explained the requirements of the Consumer Protection Act and by-laws. As a result, the rights and interests of citizens as consumers were protected, and the faulty TV was replaced with a new one.
To the attention of consumers!
Uzbekistan's Consumer Protection Act establishes the following.
1. When selling a defective item, the consumer at his discretion, if this circumstance was not specified at the conclusion of the contract:
- exchange of goods for goods of acceptable quality with the same brand (model, article);
- exchange the goods for the same product of another brand (model, article) with the corresponding recalculation of its purchase price;
- gratuitous removal of product defects or reimbursement of the costs of the consumer or third party for the elimination of defects;
- reducing the purchase price in proportion to the defect;
- have the right to terminate the contract and to claim damages.
2. If the consumer detects defects or other defects related to the manufacture, structure, composition of the goods, the seller (manufacturer) is obliged to replace it with a similar branded (model, articulate) product within seven days.
If additional quality checks are required by the seller (manufacturer), the consumer is obliged to make a replacement within twenty days of the presentation of the demand.
In the absence of the same branded (model, articulate) product, the consumer's request for exchange must be satisfied within one month of the claim being made.
With the consent of the consumer, the seller is obliged to make an appropriate recalculation of the purchase price, replacing the defective goods with the same product of another brand (model, articulate).
3. When the price of the goods is changed at the time of replacing the defective product with the same brand (model, articulation) recalculation is not made.
When exchanging a defective item for a product of another brand (model, Articulation) the consumer must additionally pay the difference in price, if the price of the goods to be replaced, lower than the price of the goods supplied in return.
The difference in price is returned to the consumer if the price of the goods to be replaced is higher than the price of the goods supplied in return.
In the case of this calculation, if the price of the item to be replaced increases, its price is applied at the time of the request, and if the price decreases, the price at the time of purchase is applied.
